    Request of Information Protocol 

    (El Paso, TX) Thursday,
     October 1, 2009 – As you may know the Public Information Office for El Paso County has changed.As of Monday, October 5, 2009 all members of the media and the general public must request information to individual departments and/or each elected official.
    El Paso County Commissioners Court meets every Monday at 9:30 a.m. in the Commissioner Court Chambers located in the third floor of the county courthouse.
    The agenda to be considered during the meeting, special meetings and minutes gets posted every Thursday afternoon in the Government main web page at
    http://www.epcounty.com/government.asp 
    Although the county of El Paso has no formal policy for requesting information through the Freedom Of Information Act (FOIA) or Texas Open Records, any member of the public or the media are advised to request information via written letter to an elected official’s office or department.  

    State guidelines are as follows: Section 552.201 of the Texas Government Code says the following:

    (a)    The Chief administrative officer of a governmental agency is the officer for public information, except as provided by Subsection
    (b).
    (b)    Each elected county officer is the officer for public information and the custodian, as defined by subsection 201.003, Local Government Code, of the information created or received by that county officer’s office.

    Section 552.202 of the Texas Government Code states:
     
    Each department head is an agent of the officer for public information for the purposes of complying with this chapter [Public Information Act].
    Thus, this means that the County Judge is the public information act officer for the County of El Paso, and each department head is an agent who can receive Public Information Act requests for their county department. 
    Section 552.201(b), however, makes it clear that each elected officer is the public information act officer for his/her own office, and the County Judge is not someone who can receive and handle public information act requests for these elected offices.

    The first of three public meetings to discuss the development of a Stormwater Master Plan for the County of El Paso will be held on Wednesday, September 16.
    The project is being funded jointly by El Paso County and the Texas Water Development Board, with project management services provided by EPWU.
    URS, an engineering firm, has been hired to complete the study which will identify flooding locations in the County and recommend improvements. 
    “This is the first step towards providing relief to County areas that have historic flooding issues,” said EPWU President and CEO Ed Archuleta. “A comprehensive plan should be in place before any plans for improvements move forward.” 
    The purpose of the meeting is to provide background and the intent of the Stormwater Master Plan and get public input.
    The project findings will be summarized in a written report describing repeated problem flood areas and potential measures to prevent future flooding.
    The public is invited to attend, and written and oral comments will be accepted.

  • Commissioners Court Meeting Highlights for Monday, September 14, 2009

    County and Sheriff’s Union Reach Agreement
    (El Paso, TX) -- In today’s meeting, Commissioners Court accepted the offer made by the El Paso County Sheriff’s Officers Association to waive the cost of living allowance (COLA) increase for the months of October 2009 and April 2010; in return, the county agreed to a two-year expansion of their contract, which was due to expire in 2012 and will now end in September 30, 2014.
    Under the current contract, Sherriff’s deputies are entitled to a cost of living increase every six months. This agreement will save the county 1.2 million for fiscal year 2010.
    “This proposal is an example of how the ranking file of the Sheriff’s Office is committed and sensitive to the needs of the tax payers of this community. They know that we are in a tight budget crisis and this really goes to speak to the union character and their commitment to El Paso county constituents,” said County Judge Anthony Cobos.
    The County Judge commended the Sheriff’s union leader and County Commissioner Pct. 1 Anna Perez for taking the lead in the negotiations.
    The motion made by County Commissioner Pct. 1 Anna Perez and seconded by County Judge Cobos was approved unanimously. 

    September is Hunger Action Month


    County Commissioners Court
    has adopted a resolution recognizing September as the “Hunger Action Month” in El Paso County.
    During the adoption of the resolution, which was sponsored by County Judge Anthony Cobos and seconded by County Commissioner Veronica Escobar, officials with the West Texas Food Bank stated that hunger is an issue in our community and that one in every four people in our area suffers as a result of lack of food due to poverty.
    It is estimated that in El Paso County around 200,000 people do not have a daily meal and the number continues to grow, officials said. Therefore, in an effort to increase awareness about this problem and to highlight the generosity of non-profit organizations and the private sector in their efforts to fight hunger, El Paso County Commissioners court unanimously approved such resolution.|
    Locally, the West Texas Food Bank distributes over five million pounds of food and provides emergency and temporary food assistance to more than 118,000 people per year through the help of more than 180 non-profit partner agencies. 
    On September 16, the non-profit organization in partnership with Fred Loya Insurance will deliver 300 baskets of food at 800 N. Zaragoza for needy people.
    With every dollar donated to the West Texas Food Bank, they are able to provide up to seven warm meals for people in need.

    Ascarate Park Update 

    As part of the county efforts to upgrade Ascarate Park facilities, members of Commissioners Court awarded a $79,894 contract to a local company to re-design four baseball fields.
    The baseball fields will remain in the same location but will be of uniform dimensions. In order to complete this phase of the project, the handball courts will be moved and new courts will be built in a nearby area to better accommodate the players.

    In addition to re-designing the fields; new backstops, dug outs and fencing will be placed.
    In the future, the county will be also upgrading the irrigation system to preserve the fields’ playing condition.

    When completed, Ascarate will have six ball fields available for the public’s enjoyment.

    (El Paso, TX) Thursday, September 3, 2009 - In observance of Labor Day, the El Paso County Courthouse will be closed to the public on Monday, September 7, 2009.

    Commissioners Court’s regular session will not take place.

    The offices of the District and County Clerks will not be available to the public, nor will their satellite offices in the Northeast or the Ysleta Annex.

    We urge the community to take this into consideration and plan ahead in case there is the need to use a service provided by the county. For example; application for passports, birth and marriage certificates, deeds, etc.

    For the public’s convenience, the county courthouse and its satellite offices will be open during regular office hours on Friday, September 4, 2009.
    Ascarate
    Park, Ascarate Golf Course and the Aquatic Center will be open for the Labor Day holiday weekend.
    The Labor Day holiday weekend marks the end of the pool season. Admission is $2 for adults and children at the Ascarate Aquatic Center and $1 for the Gallegos (Canutillo) and O'Donnell (Fabens) pools.
    Pets are allowed in the park with a leash and non-alcoholic beverages are permitted within the park premises.
    Seniors (65 or older) are not required to have a fishing license and their admission is FREE. 
    Ascarate Golf Course will be open from 6:00 a.m. to 8:00 p.m. and the driving range until 10:00 p.m.County residents with any emergency must call 911 for immediate assistance or the Sheriff's Office Dispatch for non-emergency calls at (915) 546-2280.
    Normal operations for all offices and facilities will resume on Tuesday, September 8, 2009.

  • County Creates Ethics Commission

     (El Paso, TX)Tuesday, September 1, 2009- In a special session held this morning El Paso County Commissioners unanimously approved the creation of an Ethics Commission by November 2, 2009.
    The creation of a 10-member body will oversee compliance of the County’s Ethics Code: one appointed by each member of Commissioner's Court, and 5 representatives from the public agencies dedicated to arbitration, human resources and legal services. The Court will select from slates submitted.
    The new Ethics Code Legislation was approved by the 81st Texas Legislation and takes effect today.
    Under the provision, the new legislation provides statutory authority and enhanced power to County to establish a County Board of Ethics and authorizes the newly-approved El Paso Ethics Commission to assess civil and criminal penalties for violations of the ethics code.
    Some of the penalties contemplated in the proposed legislation include fines of up to $4,000 for violations, fines of up to $500 for County public servants (Elected County officials, County employees and agents), lobbyists and vendors who delay providing information to the Commission, and up to 3 months in jail for unauthorized destruction or release of confidential information.

    Additionally, the members of the court directed the Human Resources Director to draft a letter to be sent by the County Judge inviting participation by selected entities.  (CC08-09-87)

    Court Informed about New Guidelines for MHMR

    (El Paso, Texas) – Due to lack of funding, the state-designated Mental Health/Mental Retardation Authority for El Paso County will close its doors to new consumers and establish a waiting list for services affecting 1,500 people with mental illness.
    El Paso MHMR officials explained to the court about their hope of receiving monies from the state during its 81st legislative session to prevent a waiting list, but albeit legislative efforts no additional funding was granted. 
    As a result, selected consumers will no longer be receiving services such as medication and therapy beginning September 1, 2009. 
    During this morning’s update, MHMR officials assured Commissioners Court that teams are working to determine which consumers will be released from services.
    Those patients to be released are individuals who have been stable and have been receiving services for a long period of time.
    Additionally, the members of the court were informed that the caseworkers will assist all affected individuals in order to facilitate the transition process and find other sources of care whenever possible.
    During today’s meeting, County Commissioner Pct. 3 Willie Gandara expressed his intention to approach city officials to find a prompt solution to the funding shortfall and continue providing the service to mentally ill patients in El Paso County.It was also noted that crisis services will not be affected for those individuals who pose an immediate threat to themselves or others.
    The El Paso MHMR Emergency & Crisis Department will continue to remain open 24/7 for crisis intervention and the 24-hour crisis line at 779-1800 will remain operational as well.
     

    COUNTY RECOGNIZES THE TEXAS ALLIANCE CAMPAIGN KICK-OFF DAY 

    El Paso County Commissioners Court adopted a resolution proclaiming August 29, 2009 as the Reform Immigration for Texas Alliance Campaign Kick-Off Recognition Day.
    The resolution, sponsored by County Commissioner Pct. 2, Veronica Escobar, states that the County of El Paso supports the principles of the Reform Immigration for Texas Alliance towards a more comprehensive immigration reform that include the provision of a pathway to citizenship, keeping families together, the respect of civil liberties and rights, and the establishment of a responsible and accountable border policy, amongst others.
    The resolution was adopted by a 4 to 0 vote. 

    County Raises Copy Costs 

    The members of Commissioners Court unanimously approved an increase in cost per copy to the public. The new cost for black & white copies will be of $0.20 (twenty cents) each and $0.50 (fifty cents) per color copy.
     The new fees are effective immediately.
     

    Familias Triunfadoras Agreement Renewed

    Colonia residents from the San Elizario Community came before the court to request the renewal of the contract with the non-profit organization Familias Triunfadoras to administer the operations of the San Elizario Community Resource Center.
    The Familias Triunfadoras, Inc, was founded in 2006 and is a women-led, grass roots organization dedicated to empowering women and their families.
    The organization uses the San Elizario Community Resource Center, located at 12500 Socorro Road in San Elizario, to host its operations, programs and to serve as a community meeting place.
    Some examples of its assistance are: health screenings done in partnership with the University Medical Center, distribution of hygiene products, and medical equipment in partnership with the area Agency on Aging.
    The non-profit organization also partners with the County’s General Assistance program to assist individuals and families in accessing emergency services if needed.
    The court approved the renewal of the first of four allowable one-year agreements, which will come into effect on October 1, 2009 to September 30, 2010.

    Revolving Loan Program

     (El Paso, Texas) – Existing or new businesses located outside of El Paso City limits can take advantage of funds made available through El Paso County Revolving Loan Program.
    The funds will be available to help those existing or entrepreneurial projects with genuine growth potential.
    The RLF is a public sector financing tool designed to stimulate economic growth in the rural areas of El Paso County and provides capital for private projects, which would not be possible without such assistance.
    The funds will offer between $10,000 and $50,000 to small and medium-size enterprises. The fund recipients are required to use it to purchase equipment/machinery and operating working capital only.
    El Paso County created the RLF from program income via grants provided by U.S. Department of Housing and Urban Development through the State of Texas.
    In accordance with national objectives, the funds support the creation of permanent new jobs and/or retain existing jobs; it targets primarily low and moderate-income persons.

     Lady Justice Statue to Return to the Courthouse
    Court Approves Restoration Efforts 
    (El Paso, Texas) - In today’s meeting, Commissioners Court accepted a plan to re-install a refurbished Lady Justice statue in a suitable location at the County Courthouse after the completion of conservation and restoration efforts.
    Commissioner Court authorized a committee of individuals, lead by Chief Justice David Wellington Chew, to secure funds to complete a conservation and rehabilitation effort.
    Lady Justice, absent from the Courthouse for almost 93 years, has sustained substantial damage over the years.  Her left hand and sword are missing as is her scale of justice.
    The citizen based committee will solicit donations from the community and from the County’s Hotel Occupancy Tax funds (HOT) for the restoration and placement of the statue.
    The first step in the process is performing a conditions assessment. This will guide the conservation and preservation efforts.
    Meanwhile, the El Paso Community Foundation agreed to be the fiscal agent for a community fund drive similar, on a smaller scale, to the efforts made to save the Plaza Theater.
    Rosemary Neill, Director of the Family and Community Services informed the court that any funds remaining from the conditions assessment will contribute toward the restoration.
    The proposed site for the statue is to be mounted in a pedestal in front of the courthouse entrance.

    Background Information:
    The architects designing the 1886 El Paso County Courthouse commissioned a statue, Lady Justice, to overlook the Courthouse.
    The statue is unique because her face has no blindfold covering her eyes. Most statues of this type show a figure with a blindfold holding the scales of justice.
    Historians and preservationists believe W. H. Mullins stamped the zinc sculpture. Mr. Mullins had a studio in Brooklyn, New York.
    Some historians believe there was a companion statue made to complement Lady Justice.
    Lady Justice graced the Courthouse until 1917. Demolition of the Courthouse in 1917 required moving Lady Justice to a new location. Lady Justice moved to a nearby park adjacent to Liberty Hall. Lady Justice then moved into Liberty Hall. Her final home was Ascarate Park.

    The Sheriff’s Department is evaluating any impact to security at the Courthouse in addition to security for this historic sculpture.

    Court Accepts El Paso County and University Medical Center Tax Rate Proposal for FY 2009-2010  
    (El Paso, Texas) - In today’s meeting, the members of Commissioners Court accepted the effective and rollback tax calculations from the County Tax Assessor-Collector’s office for both the County and the University Medical Center of El Paso (Hospital District). 
    The effective tax rate is a rate that raises about the same total revenue as last year on properties taxed in both years. 
    The rollback rate is a calculated maximum rate allowed by law without voter approval. 
    The County of El Paso’s calculations are as follows:  Effective Tax Rate of $0.338258 per $100 assessed value and Rollback Tax Rate of $0.369379 per $100 assessed value. 
    If the County of El Paso adopts a 2009 tax rate equal to the effective tax rate of $0.338258 per $100 of value, taxes would increase compared to 2008 taxes by $2,407,617. 
    The County’s current tax rate is $0.342437 per $100 assessed value.
     
    Additionally, the court accepted the effective and rollback tax calculations for the University Medical Center of El Paso (UMC) as follows:  Effective Tax Rate of  $0.179405 per $100 assessed value and a Rollback Tax Rate of $0.189167 per $100 assessed value.
    If the University Medical Center of El Paso adopts a 2009 tax rate equal to the effective tax rate of $0.179405 per $100 of value, taxes would increase compared to 2008 taxes by $1,365,354. 
    UMC’s current tax rate is $0.181504 per $100 assessed value.
     
    If members of Commissioners’ Court propose to adopt a tax rate that exceeds the rollback rate or the effective tax rate, whichever rate is lower, they are required to hold two public hearing and publish newspaper ads before adopting a tax rate in accordance to Tax Code Section 26.05(d).
    Last, but not least, the notices for the County of El Paso, University Medical Center of El Paso and the El Paso County Community College (EPCC) were approved for publication in both the El Paso Times and El Diario both with major circulation, which will run on or about the week of August 17, 2009 to inform El Paso citizenry about the tax rate calculations. 
    These notices will also be available on the County’s website www.epcounty.com on or about the same date of publication in accordance with Texas Tax Code laws. 

                                                                                       

    Court Approves Resolution in Support of Completion

    of Eco-Park on the U.S.- Mexico Border


    Members of Commissioners Court adopted a resolution to encourage officials of both the United States and Mexican governments, state officials and the private sectors to persuade President Obama and President Calderon’s Administrations to establish an international commission.
    This commission will help promote the completion of an international park between Big Bend National Park in the United States and the protected areas of the states of Coahuila and Chihuahua across the border in Mexico.
    The Resolution, sponsored by County Commissioner Pct. 2 Veronica Escobar, states that there is a renewed interest on the part of government officials in both countries that recognizes the need to preserve the ecology and environment of the entire area and promote tourism.
    The Big Bend National Park in West Texas has been a region of high tourist interest since 1944.
    In early 1935, it was proposed that the region should be established as an international park and a monument to the friendship and good will that exists between the people of both countries.
    The proposal was made by Senator Morris Shepherd of Texas, with support from both President Roosevelt and President Truman of the United States and President Manuel Avila Camacho of Mexico.
    The Resolution which also called for the creation of an Eco-tourism committee in El Paso was approved in a 4 to 0 vote. 

     Health Benefits for Domestic Partners

    The item to form an exploratory committee to provide health benefits to domestic partners was postponed for one week.
    The item on today’s agenda, sponsored by the El Paso County Judge Anthony Cobos, was intended to direct the Risk Pool Board and the Human Resources Department to form an exploratory committee composed of several county departments –including the County Attorney’s Office and the County Auditor’s Office, and present different options to possible benefits to the court.

    Now Enrolling

    El Paso, TX) – The First Tee of Greater El Paso program will begin its Fall Season classes for new beginner TARGET program participants on Thursday, September 17 for children aged 7 to 18.
    The classes will be every Thursday for 7 weeks from 4:30p.m. to 6:00 p.m.
    The continuing Player-Par Program (PAR) will begin on Tuesday September 8 from 4:30 p.m. to 6:00 p.m.
    The classes for the PAR program will offered on Monday, Tuesday and Wednesday for 8 weeks.
    The nonprofit program has an enrollment cost of $50 and $25 per session with scholarships available for those who require it.
    The activity fee a
    llows members to utilize the golf courses, learning center, and enters them into The First Tee Life Skills Program; paying for their Life Skills materials.
    The First Tee of Greater El Paso aims to impact the lives of young people in our area by providing learning facilities and educational programs that promote character development and life-enhancing values through the game of golf.

    LULAC’s Gran Festival
    (El Paso, TX) – The first annual Gran Festival sponsored by the League of United Latin-American Citizens Council 132 will be held this weekend at Ascarate Park.
    The festival will feature one musical performer each day; Banda Machos (Friday), Kumbia Allstarz (Saturday), and Sonny Ozuna and the Sunliners (Sunday).
    Tickets are $10 in advance and $12 at the gate. Children 12 and under FREE.
    The festival will sell alcoholic beverages in a contained area.
    The County Parks and Recreation Department does not allow alcoholic beverages in the park for individual consumption.
    Attendees are encouraged to bring their chairs, however no tents will be allowed because they could impair the view of others.
    On Saturday, there will be a Huacha Tournament and registration starts at 11:00 a.m.
    On Sunday there will be a car show.

     El Paso County to Improve
    Water Service f
    or Colonia Residents

    (El Paso, TX) – Over a thousand of Colonia resident’s located far-east of the county will have access to quality water for the first time, thanks to the approval of $1.5 million for two water improvement projects.
    The members of commissioners court unanimously approved both proposals allocating money from the 2002 and 2007 Capital Improvements Fund.
    The first project which involves close collaboration with Lower Valley Water District through a 3.5 miles extension of a 12 inch water line to provide clean water to about 150 families or 600 residents of the Lourdes and El Conquistador sub-divisions located adjacent to Fabens.
    “My priority is to close the gap in potable water needs in all the county, families in El Paso deserve access to water in order to have better quality of life,” said County Commissioner Pct. 3 Willie Gandara.
    The second project which involves close collaboration with the Tornillo Water Supply Corporation is the construction of new water well in the area of Tornillo. This will provide approximately 300 families or 1200 resident’s access to first-time water.

      DRO Director Retires 

    El Paso County Commissioners Court honored the retiring Executive Director of the Domestic Relations Office (DRO),
    Terry Pasqualone.
    County Judge Anthony Cobos presented him with a plaque in appreciation and recognition for his dedication and devotion to the principles and ideals of the Domestic Relations Office and his service for the County of El Paso.
    Mr. Pasqualone, a former Family Judge, will retire after nine years of continuous service leading the El Paso County Domestic Relations Office.
    “The DRO has met its challenges through your administration and you’ve handle them with dignity and integrity. You are truly an example of good government that works for the people,” said County Commissioner Pct. 1 Anna Perez.
    Terry Pasqualone has served as the DRO Execute Director since 2000. He will retire effectively on July 31, 2009.  

     

  • NEW PROJECT MANAGER SELECTED

    New Project Manager Selected for Border Children Mental Health Collaborative
    (El Paso, TX) – Rita Ruelas, Family Court Services Chief for the Department of Domestic Relations (DRO) has been named Project Manager of the Border Children Mental Health Collaborative (BCMHC).Ruelas, who was top choice among the 4 finalists, was nominated during Monday’s regular meeting by County Commissioner Pct. 4, Daniel R. Haggerty.
    Ruelas succeeds Roger Martinez, whom on June 1st was selected as the new Chief Juvenile Probation Officer of the Juvenile Probation Department.Ms.
    Ruelas has 27 years of experience as a social services professional in our community.
    She joins the collaborative after nine years with the DRO; while in the DRO, she led the agency to develop and implement social services provided by the Family Court Services Division and created a uniform format for Contested Custody Social Studies utilized by the Family District Courts, among other achievements. 
     
    The new project manager for the BCMHC has held various social services positions in our community including working at the Lee and Beulah Moor Children’s Home as Director of Adoptions and Foster Care and actively participated in several boards such as the Mental Health Mental Retardation Board, the Child Welfare Board and the Board of Directors at La Fe.
    “Rita has long been a highly respected social worker in El Paso and we are so please to have her join us to start the office and very proud to see her move on to the director of the Border Children Collaborative,” said Terry Pasqualone, Executive Director of the Domestic Relations Office.
    Ms. Ruelas holds a B.A. Degree in Social Work from the University of Texas at El Paso and a Masters Degree in Social Work from the Our Lady of the Lake University.
