Earlier this month, Sunday, June 8th, 2008 at 3:45 PM, Sheriff Deputies responded to an Arson call at 500 Talbot, Canutillo, TX at the Gaslight Square mobile home parking lot. Sheriff's Detectives and the El Paso Fire Department Fire Marshalls arrived to investigate the suspicious fire. It was determined by investigators the fire was set intentionally and was labeled as an Arson. In total, 2 RV’s and 1 Pick-up truck were damaged and the total loss amounts to more that $15,000 dollars.

The El Paso County Sheriff’s Office in coordination with Crime stoppers of El Paso were set to release this case as the "Crime of the Week" for the weekend of June 27-29, 2008-asking the public for their assistance in providing additional information to help solve this crime. 

On 06-25-08, Sheriff’s Detectives received a tip leading investigators to a residence at  850 Talbot Rd(Transmountain Village)-located next to Gas Light Square mobile home & RV Park. After a brief investigation, Sheriff's Detectives determined that a 10 year-old resident of the park was in fact responsible for the unsolved Arson fire. On 06-27-08, Sheriff's Detectives took the 10 year-old boy into custody for Arson. The 10 year-old admitted to Sheriff's Detectives he used a propane torch to set ablaze the fire. The 10 year-old was taken to the Texas Juvenile Probation Department for processing. He was released to his mother a short-time later.

This case has been SOLVED / CLEARED BY ARREST & will be forwarded to the County Attorney`s Office for final review and disposition.

Arrest #1

Wednesday night 06-25-08 at 7:21 PM Sheriff Deputies were called out to a residence at the 1300 block of Camelia, Canutillo, TX in reference to a family violence call. Apparently the female caller told dispatchers that her 20 year-old son was being very violent, out of control and damaging the interior of the home. Deputies arrived moments later and located the 20 year-old in the rear portion of the residence. Deputies quickly took him into custody. The mother / victim told Deputies she saw her son damage several walls inside the residence. The mother estimated the damage to the home to be over $1,000. While conducting a wanted persons check on the 20 year-old, it was discovered he had an outstanding criminal warrant for Assault Causing Bodily Injury / FAMILY VIOLENCE with a $10,000 Bond.

The subject was arrested & charged with Criminal Mischief over $500 under $1,500 & the outstanding warrant. He was identified as Isidro Melendez (20) of the 1300 block of Camelia in Canutillo, TX. He remains at the El Paso County Detention Facility.

Arrest #2

A short time after the first incident, at about 9:05 PM, Deputies were patrolling the area of the 7440 block of Doniphan in El Paso County TX when they observed a female flagging down vehicles for a ride.  Deputies then conducted a welfare check with the subject. Upon making contact with the female subject she asked Deputies for a ride. Deputies asked her for identification but she claimed not to have one. The female subject was acting suspicious & gave authorities a name & date of birth. Deputies received a return on that identity as having an outstanding SO criminal warrant. The female subject then changed her story and information giving Deputies her real name. Deputies ran a wanted persons check on the 2nd name and received a return from dispatchers as her having 3 EPPD outstanding warrants for 1.) Fail to Identify 2.) Escape from custody 3.) Theft over $50 under $500.

Deputies took her into custody and arrested her for the outstanding criminal warrants & added an additional charge of Failure to Identify-Fugitive from Justice

The female was identified as Marilyn Marie Mendez (39) of the 800 block of Gato Rd. in Canutillo, TX. She remains at the El Paso County Detention Facility.

INFORMATION: 

On Tuesday evening, 06-24-08 at 7:22 PM Sheriff Deputies were patrolling the area of Fabens, TX when they spotted a black  2004 GMC Yukon driving recklessly. Deputies tried to stop the reckless driver after observing the black Yukon nearly colliding with other motorists. Deputies suspected the driver might be highly intoxicated. The driver refused to stop and attempted to elude authorities. Sheriff's Deputies pursued the black Yukon for several miles until they lost visual of the pick-up truck in a desert area near Horizon. After searching surrounding areas, Deputies located the black GMC Yukon which was stuck in the desert sand. Several moments later, concerned citizens called to report a “suspicious subject” walking around the neighborhood. The subject fit the description of the driver, and was apprehended by Deputies who were also able to positively identify the subject (place him behind the wheel) as the driver of the GMC Yukon involved in the pursuit.

No injuries were reported as a result of the pursuit.

The driver was arrested and charged with Evading Arrest Detention w/ vehicle & Driving While Intoxicated. He was identified as Anthony Ordaz (27) of the 900 block of Warwick.

He remains at the El Paso County Detention Facility.

The El Paso County Sheriff’s Office and the El Paso Police Department working with the Texas Department of Transportation Education & Enforcement will be utilizing a GRANT for additional patrols for traffic enforcement. The purpose of this program is aimed at getting speeding & impaired drivers off the roadways. Extra Deputies & Police Officers will be out on the streets during the Independence Day Holiday period. The push is to deter drunk driving. The enforcement program begins Friday, June 27th, 2008 through Sunday, July 6th, 2008.

Statistics from the Texas Department of Transportation indicate Texas leads the nation when it comes to the number of traffic fatalities where the driver or motorcycle operator was legally drunk. Last year 1,677 people died in alcohol-related crashes in Texas.

Penalties for a first-time DWI offense include :

  • Up to $2,000 fine
  • 72 hours to 6 months in Jail
  • Driver’s license suspension for up to one year
  • $1,000 annual fee for 3 consecutive years to retain drivers license

Information:

Accident #1

On Tuesday, 06-24-08 at 1:15 PM Sheriff Deputies were dispatched to the area of Loop 375 Mile Post 34 in reference to a single vehicle roll-over with possible injuries. Deputies arrived moments later and began working the accident. Deputies determined that a gold 2001 Chevrolet Blazer driven by a 38 year-old female driver was traveling southbound on Loop 375. The Chevrolet Blazer swerved right to avoid colliding with another vehicle then swerved left driving into the median and overcorrected right driving across the main travel southbound lanes losing control of the truck. The Blazer rolled on its side and stopped facing north in the desert area just next to the southbound lanes of Loop 375.

There were 2 occupants in the Chevrolet Blazer. It was driven by 38 year-old Rebecca De Leon Fernandez (38) of the 10000 block of Kenworthy, El Paso, TX. She was accompanied by her 13 year-old son who was sitting in the front passenger seat (he will not be identified because of his age). Both were wearing seatbelts and did not suffer serious bodily injuries. they were transported by Ambulance to a local hospital for further evaluation. This accident is still under investigation. About 200 yards of a southbound lane of traffic was closed for about an hour.

Accident #2

On Tuesday, 06-24-08 at 1:45 PM while Sheriff Deputies were working an accident on Loop 375 Mile Post 34 (just right of the southbound lanes). Deputies witnessed a second accident take place on the northbound lanes. A gold 1995 Toyota Camry driven by a 20 year-old female driver was traveling northbound approaching Loop 375 MM 34. The driver of the Camry suddenly slowed down due to the accident on the southbound lanes when she was struck from behind by a 2008 GMC Sierra pick-up truck. The truck was driven by a 30 year-old male traveling directly behind the Camry. The impact caused the driver of the Camry to drive into the median and across the southbound lanes & into the desert area about 50 yards from where the 1st vehicle rollover accident was located. Southbound traffic stopped just avoiding colliding head-on into the Camry. No injuries were suffered in this 2nd accident. Deputies continue the accident investigation.

Sheriff's Office Crime Prevention Section /Sheriff's Office Explorers witness accident

As Deputies were working the 1st accident rollover. The El Paso County Crime Prevention Section was hosting a course for Sheriff's Office Explorers relating to traffic accidents. This course shows students how to work a traffic accidents & teaches them about accident measurements & scene safety. The Sheriff's Office Explorers were then transported to the site of the roll-over accident to get a 1st hand look at an accident scene. After the occupants were transported to the hospital and the accident site was deemed safe. The Sheriff's Office Explorers accompanied by Deputies in the Crime Prevention section were observing how an accident is handled when suddenly they witnessed a 2nd accident take place. At no time were any Sheriff's Deputies or Sheriff's Office Explorers in harms way. Right now, the Crime Prevention Section along with Sheriff's Office Explorers are getting ready to attend the 2008 National Law Enforcement Explorer Conference (NLEEC) being held at Colorado State university, Ft. Local man married to 2 women arrested for BIGAMY by Sheriff Deputies

INFORMATION:

On June 10, 2008, Sheriff Deputies received a complaint from a local female victim claiming that she discovered that her husband who she had not heard of in over a year was married to another local woman. The victim told Sheriff's Investigators that on or about November 2001 she met & started dating Luis Enrique Juarez. The victim claimed soon after, Juarez moved into her apartment & they formally became married in November 2004 while on vacation in Florida (Miami-Dade County, Florida). The victim stated they lived in Texas but wanted to get married while in Florida. The victim claimed the couple returned to Texas and continued to live as husband and wife until around March 2006. The victim stated they soon separated and Juarez agreed to move out of their home. The victim stated she repeatedly asked Juarez for a divorce and he would tell her that he was not paying for a divorce.

In July 2007, Juarez again contacted the victim by phone and explained that he was at the El Paso County Court House and there was no record of their marriage to each other. The victim again insisted they get a formal divorce. The victim claimed Juarez told her that since a record of their marriage was kept on file in Florida, Texas had no way of knowing he and the victim were married. The victim stated she and Juarez had not spoken since that conversation on the phone. In May 2008, the victim received credit statements which had incurred regarding her & Juarez. The victim again began searching for Juarez to contact him about credit issues and again request a divorce.

The victim hired an attorney and who was able to locate copies of 2 different marriage certificates showing Juarez currently being married to 2 local women. The 1st certificate (Florida) showed Juarez & the victim being married since November 2004 & the 2nd marriage certificate showing Juarez & his 2nd current wife being married since last August 2007. The victim filed charges against Juarez for Bigamy.

Luis Enrique Juarez (37) of the 14000 block of Tierra Bronce was arrested & charged with BIGAMY. He remains at the El Paso County Detention Facility.

TITLE 6. CHAPTER 25. OFFENSES AGAINST THE FAMILY

§ 25.01. BIGAMY.

(a) An individual commits an offense if:

(1) he is legally married and he:

(A) purports to marry or does marry a person other than his spouse in this state, or any other state or foreign country, under circumstances that would, but for the actor's prior marriage, constitute a marriage; or (B) lives with a person other than his spouse in this state under the appearance of being married; or

(2) he knows that a married person other than his spouse is married and he:

(A) purports to marry or does marry that person in this state, or any other state or foreign country, under circumstances that would, but for the person's prior marriage, constitute a marriage; or (B) lives with that person in this state under the appearance of being married. (b) For purposes of this section, "under the appearance of being married" means holding out that the parties are married with cohabitation and an intent to be married by either party. (c) It is a defense to prosecution under Subsection (a)(1) that the actor reasonably believed at the time of the commission of the offense that the actor and the person whom the actor married or purported to marry or with whom the actor lived under the appearance of being married were legally eligible to be married because the actor's prior marriage was void or had been dissolved by death, divorce, or annulment. For purposes of this subsection, an actor's belief is reasonable if the belief is substantiated by a certified copy of a death certificate or other signed document issued by a court. (d) For the purposes of this section, the lawful wife or husband of the actor may testify both for or against the actor concerning proof of the original marriage.

(e) An offense under this section is a felony of the third degree

INFORMATION: 

The El Paso County Sheriff's Office in coordination with the United States Border Patrol, the Texas Border Sheriff’s Coalition, the Coastal Bend Sheriffs Coalition and border area police departments, the State of Texas launched Operation Border Star in mid-September. This operation is a unified high intensity, multi-agency effort focused on reducing crime in targeted regions along the Texas-Mexico border. The operation will continue for a time period that will remain undisclosed for operational security purposes.

“By joining together with our local, state and federal partners, we will support the men and women of the U.S. Border Patrol, and protect our communities by dominating the border,” Perry said. “While securing our international borders is ultimately the responsibility of the federal government, Texas can and will assist in that effort to maximize its effect.”- Governor Rick Perry

Over the weekend, on 06-20-08 at approximately 12:40 PM. Sheriff Deputies working Operation Border Star conducted a traffic stop on a Green 2000 Nissan Sentra at the 400 block of Piedras in El Paso, Texas. Deputies made contact with the driver an explained the reason for the traffic stop which was for failing to drive in a single lane. The driver told Deputies he was unfamiliar with the area and was also distracted by talking on his cellular phone which caused him to swerve. Deputies noticed that driver was acting very nervous and was evasive of questions asked of him. Deputies sought & obtained consent from the driver to search the vehicle. Deputies began searching the vehicle and located a partially opened blue travel bag under the front passenger seat of the vehicle.  Further investigation revealed the travel bag contained several plastic bags of cocaine (approximately 400 grams).

The driver was placed under arrest and charged with Possession of a Controlled Substance >200 grams < 400 grams (Cocaine)-1st Degree Felony.

He was identified as Gerardo Garcia-Carillo (35) of the 900 block of Adams, Anthony, NM.  He remains at the El Paso County Detention Facility under an $80,000 Bond.

WHY: Formally announce the college scholarship program. Scholarships were recently named to honor former ASIS member J. R. Grijalva (Chief of Police, El Paso Community College) and El Paso County Sheriff Leo Samaniego.

 The Chapter Board of Directors voted unanimously to approve these permanent scholarships. The first scholarship, given to an ASIS International member from the El Paso/Juarez chapter will hereafter be known as the JR Grijalva Memorial Scholarship. Grijalva was an active member of the El Paso/Juarez Chapter. He received the scholarship award twice in the past. ASIS International matches the funds awarded by the chapter, giving the recipient an even larger scholarship.

The second scholarship will be named the Leo Samaniego Scholarship. This scholarship is given to a college student studying criminal justice or security management. It is open to all who meet the minimum qualifications set by ASIS International.

“Sheriff Samaniego was a proponent of training and education. It is fitting a scholarship in his name is being used to enhance and prepare someone for a career in law enforcement or security. This is a tribute to his legacy of excellence,” said Sheriff Jimmy Apodaca, El Paso County, Texas.

“It is our distinct pleasure to honor two men who have served their community for most of the lives and who were loved and respected by their family, friends and all the people they touched,” said Henry Camacho, Scholarship Chair, ASIS El Paso, Texas.

All scholarship applicants must apply to the El Paso/Juarez Chapter, have their completed application accepted and reviewed by the Scholarship Committee and then finally approved by the Chapter Board of Directors. Funds for these and other scholarships given by the Chapter are raised through the annual Law Enforcement vs. Private Security Golf Tournament and other contributions.

 INFORMATION: 

Late Friday afternoon, 06-13-08 at about 4:00 PM  while driving in the area of Americas & Alameda, an El Paso County Sheriff's Deputy recognized a sought after wanted suspect driving in a red BMW. The Deputy began following the suspect and coordinated his spotting of the suspect with other Sheriff's Officials in the area via radio. The Deputies followed the suspect to the area of I-10 near Bassett Center. Deputies caught up to the suspects vehicle as it began having mechanical problems & broke down in the area of I-10 east at Geronimo. The suspect quickly exited his vehicle and fled on foot across the busy Interstate in a desperate attempt to elude capture.  A Sheriff's Deputy ran after the suspect and chased him for about a mile until he was able to catch the suspect behind a convenience store located at the 6200 block of Edgemere. The suspect was identified as Michael Angelo Arellano (25).  Arellano was wanted on numerous outstanding criminal warrants: 1) Possession of Marijuana over 5 lbs-under 50 lbs $10,000 bond; 2) Possession of Marijuana over 50 lbs.-under 2000 lbs $66,000 bond; and 3) Aggravated Sexual Assault (out of the El Paso Police Dept) $50,000 bond. 4) 9 outstanding traffic warrants with EPSO / EPPD totaling $1,837.40

He was arrested and booked on all charges & remains at the El Paso County Detention Facility.

The El Paso County Sheriff's Office in coordination with the United States Border Patrol, the Texas Border Sheriff’s Coalition, the Coastal Bend Sheriffs Coalition and border area police departments, the State of Texas launched Operation Border Star in mid-September. This operation is a unified high intensity, multi-agency effort focused on reducing crime in targeted regions along the Texas-Mexico border. The operation will continue for a time period that will remain undisclosed for operational security purposes.

Late Wednesday morning 06-11-08 at 10:45 AM, Sheriff Deputies working Operation Border Star were attempting to locate a wanted subject at a residence located at the 1200 block Colina De Oro El Paso County, Texas. Deputies were looking for Humberto Esparza (40) who was wanted on outstanding criminal warrants. The warrants included charges of: 2 counts of Aggravated Sexual Assault of a child and 2 counts of Indecency with a child (sexual contact).

Deputies met with the girlfriend of the wanted subject at the residence located at 1233 Colina De Oro El Paso County, Texas.  The girlfriend was explained that authorities had information that the wanted subject was staying at the residence. The girlfriend claimed not to have seen the wanted subject in some time and claimed that he was not present at the residence at the time.

While Deputies were gathering information, the wanted felon exited the rear door of the residence, where he was met by Sheriff Deputies. He was taken into custody without incident.

Consent to search the residence was then obtained from the girlfriend. Deputies began to search the residence and found a handgun. It was recovered for processing and evidence.

The wanted felon Humberto Esparza (40) of the 1000 block of Marlow in El Paso, TX was arrested and booked under the outstanding criminal warrants.

The girlfriend was identified as Eileen Bueno (29). She was also taken into custody and charged with felony Hindering Apprehension or Prosecution.

 INFORMATION: 

Late Saturday night 06-07-08 at 10:45 PM Sheriff Deputies were patrolling the area of San Elizario, TX  when they observed a white BMW disregard a clearly marked stop sign at the intersection of Alarcon & Saltillo. Deputies attempted to conduct a traffic stop on the said vehicle but the driver refused to stop. Deputies gave chase as the driver was attempting to elude authorities driving recklessly in the near-by neighborhood. The vehicle finally pulled into a residence at the 13300 block of Andromeda. The driver then exited the vehicle & ran towards the backyard of the residence in a desperate attempt to elude capture. The driver was chased down by Sheriff Deputies and taken into custody.    

The driver was identified as Edgar Rodriguez (20) of the 13300 block of Andromeda San Elizario, TX.

Rodriguez was arrested & charged with Evading Arrest / Detention with a Vehicle. It was discovered that Rodriguez also had 5 outstanding traffic warrants. He is currently out on bond.

Information:

Early Thursday morning, 06-05-08 at 12:30 am Sheriff Deputies were dispatched to a property located at 11090 Gateway East (Magic Landing Amusement Park), El Paso County Texas in reference to criminal trespass in progress. Deputies working Operation Border Star arrived a short time later and met with the reporters who advised Deputies they observed suspicious activity inside the property grounds such as flashing lights. Responding Deputies located 2 vehicles west of the location mentioned above.

Deputies entered the property in an attempt to locate the trespassers. Deputies heard noises & observed light coming from different areas inside the park grounds.

Multiple subjects inside the property then began running towards the west part of the property near the location of their vehicles. Deputies briefly chased, caught up, & detained 6 subjects (5 males, 1 female).

Sheriff Deputies contacted the property owner who filed charges against the subjects. All 6 were arrested and charged with Criminal Trespass.

Magic Landing is private property that is surrounded by a fence and signs posted "No Trespassing."

On Sunday 04-13-08 at 2:30 PM Sheriff Deputies along with several volunteer Fire Departments were called to this same property in reference to an Arson Fire. A estimated $485,000.00 was the total loss in that fire.

Property owners advised Sheriff Deputies they would file charges against anyone else caught on their properties without their consent.

The subjects were identified as Jorge Montoya (17) of the 10700 Miller Barber, Gerardo Santoyo (18) of the 3500 block of East Glen, Felipe Ochoa (23) of the 3400 DialRock, Carmen Salazar (17) of the 400 Byrum (Chaparral), Rene Nunez (21) of the 3900 block of Breckenridge and John Carrillo (20) of the 9100 block of Kernel.

 Preliminary Investigation:

On 06-05-08 at about 9:30 AM, Sheriff Deputies were dispatched to area of the 18000 block of Montana (Highway 62/180) in reference to a single motor vehicle accident roll-over with serious injuries. Special Traffic Investigator were summoned to the scene.

Upon arrival, Officials from the Sheriff's Office & the East Montana Volunteer Fire Dept. found the vehicle on its side in the desert area just right of the roadway. There were many on-lookers and traffic was backed up for several miles. Deputies began working the accident interviewing witnesses and re-routing traffic out of the area. Traffic Investigators arrived and commenced their investigation.

Special Traffic Investigators determined that a White 1998 Ford Explorer was traveling westbound approaching the 18000 block of Montana. The 20 year-old female driver of the Explorer for unknown reasons lost control of the vehicle. The vehicle veered to the right and over-corrected left which caused the  Explorer to roll several times until it came to a stop on its side next to the roadway. There were only 2 occupants in the Explorer.

A 32 year-old female passenger was ejected from the vehicle and died at the scene. The Victim was identified as Stephanie Wahl of Carlsbad,NM.

The 20 year-old female driver was transported by ambulance to a local hospital with life threatening injuries. She is identified as Angelica Mendoza also of Carlsbad, NM. She is a niece to the victim.

Montana was closed for approximately 4 hours. Traffic had to be re-routed to Interstate 10.

This accident remains under investigation by Special Traffic Investigators.

Earlier this week,  El Paso County Sheriff Deputies working Operation Border Star arrested 2 more individuals wanted for numerous outstanding criminal warrants.

Deputies working Operation Border Star stopped an untitled Brown Chevrolet van (Ice Cream Truck) at the 8800 block of Norton, El Paso, TX.  Deputies checked the ice cream vendor who was identified as Hector Benavente (30) of the 8000 block of Ankerson, El Paso, TX. Benavente had an outstanding criminal warrant for Indecency with a child (sexual contact) - $50,000 & multiple outstanding traffic warrants. It was discovered that Benavente  was also one of the El Paso Police Departments "Most Wanted".

Benavente was booked and remains at the El Paso County Detention Facility.

Noriega was booked into the El Paso County Detention Facility. She is currently out on bond.

Information:

Early Saturday morning 05-31-08 at 1:20 AM, a Sheriff's Deputy was flagged down at the intersection of Joe Battle & Vista Del Sol in reference to a “Reckless Driver.” Moments later, the Deputy saw a vehicle matching the description provided and attempted to conduct a traffic stop. The driver of the vehicle refused to stop and attempted to elude authorities. The vehicle pursuit ended towards a construction area near Paseo Azul where the driver jumped out of the vehicle and fled on foot.

After a brief chase, the Deputy caught up to the subject while he was trying to jump over a rock wall and took him into custody. The subject was was arrested and charged with Evading Arrest / Detention with vehicle (State Jail Felony).

He was identified as Abraham Herrera (19) of the 1700 block of Glenn Campbell.

Herrera was booked into the El Paso County Detention Facility & is currently out on bond.
