Capias Pro Fine Warrant

A Hearing Notice is sent when all due diligence has been exhausted by Financial Recovery Division and the case has been returned to court. A Hearing Notice will contain a statement that the defendant has failed to satisfy the judgment and the date and time of the hearing, as per the provisions under Section 43.05 of the Texas Code of Criminal Procedure.
As per Section 43.05 of the Texas Code of Criminal Procedure, the court may issue a Capias Pro Fine or the case may be reported to a third party collection agency.
As per Section 43.015 of the Texas Code of Criminal Procedure, a Capias Pro Fine is a writ issued by the court of jurisdiction after judgement and sentence for unpaid fines and costs.
As per Section 43.05 of the Texas Code of Criminal Procedure, a court may not issue a Capias Pro Fine for the defendant’s failure to satisfy the judgement according to its terms, unless the court holds a hearing on the defendant’s ability to satisfy the judgment; the defendant fails to appear at the hearing; or the court determines that the Capias Pro Fine should be issued based on the evidence presented at the hearing.
If balance is paid in full, the Capias Pro Fine will be recalled by a Judge. If arrested on the Capias Pro Fine, an indigency hearing will be held by the jail magistrate or the court of jurisdiction to determine ability to pay.
Once you have paid your balance in full, it is your responsibility to contact Financial Recovery Division as soon as possible to have the warrant recalled. Failure to have the warrant recalled may result in your incarceration for the entire amount regardless of your payment.
Cases with Capias Pro Fine warrants cannot be paid online. Once you have paid your balance in full at a kiosk, it is your responsibility to contact Financial Recovery Division as soon as possible to have the warrant recalled. Failure to have the warrant recalled may result in your incarceration for the entire amount regardless of your payment.
