  • Whereas, on February 22, 2001, the Council of Judges, pursuant to VACCP Art. 26.05, voted to change the fees paid to criminal defense attorneys representing defendants charged with capital murder and for whom the State is seeking the death penalty. After voting, the District and County Court judges with criminal jurisdiction adopted the fee schedule for attorneys appointed to represent indigent defendants in death penalty capital murder cases as follows:

    Pre-Trial (Prior to Voir Date): $50.00/hr* $65.00/hr*
    Voir Dire and Trial:    
    1st Chair $50.00/hr* $125.00/hr*
    2nd Chair $50.00/hr* $100.00/hr*
  •  
  • Post Trial Stage
    		•
    In Court Out of Court
    Motion for New Trial:    
    1st Chair $75.00/hr $125.00/hr
    Appeals and Writes:    
    2nd Chair $75.00/hr $100.00/hr
  •  
  • These amounts to equal existing non-death approved amounts.
  • Investigator fees: $35.00/hr with prior approval of the court
  • Expert fees: with prior approval of the court
  • Travel fees: with prior approval of the court
  • NO CAPS ON TOTAL AMOUNTS UNLESS SET BY THE COURT
  • NO EXPENSES INCURRED WITHOUT PRIOR COURT APPROVAL
  • Said fee schedule to be applicable to all death penalty capital murder cases pending Trial or in Trial process as of the date.
  • It is so adopted this 22nd day of February, 2001.
