DEATH PENALTY FEE SCHEDULE

Whereas, on October 16, 2012, Commissioners Court, pursuant to VACCP Art. 26.05, voted to change the fees paid to criminal defense attorneys representing defendants charged in all felony cases. After voting, the District and County Court judges with criminal jurisdiction adopted the fee schedule for attorneys appointed to represent indigent defendants in death penalty capital murder cases as follows:

Voir Dire and Trial:
1st Chair	$135.00/hr*	$60.00/hr*
2nd Chair	$110.00/hr*	$60.00.00/hr*

Post Trial Stage
	In Court	Out of Court
Motion for New Trial:
1st Chair	$135.00/hr	$85.00/hr
Appeals and Writes:
2nd Chair	$110.00/hr*	$60.00.00/hr*

These amounts to equal existing non-death approved amounts.
Expert fees: with prior approval of the court
Travel fees: with prior approval of the court
NO CAPS ON TOTAL AMOUNTS UNLESS SET BY THE COURT
NO EXPENSES INCURRED WITHOUT PRIOR COURT APPROVAL
Said fee schedule to be applicable to all death penalty capital murder cases pending Trial or in Trial process as of the date.
It is so approved by formal action of the District and County Court Judges having jurisdiction over criminal matters this 16th, day of August, 2012.
The above fee schedules are to take effect October 1, 2012.
