  • How can I retrieve my property that was either recovered or seized as evidence?
       Property may be retrieved upon approval from the case agent and by appointment only.

  • I surrendered my firearms, ammunition and/or license to carry under a protective order, how can I retrieve my items after the order has expired?
       You will receive a letter from our office at least 30 days before the protective order expires with a “Declaration Requesting Return of Weapons, Ammunition, and or/License to carry Affidavit.”  You will have 61 days from the expiration date of your protective order to fill out and submit this affidavit to us in person. Once the affidavit is submitted we will submit it to the court that issued the protective order to request approval to release the items. You will receive another letter from our office indicating whether the request was approved or denied and what steps to take next.

  • What do I need in order to retrieve my property?
       You will need to contact the evidence office (915) 538 – 2283 to set an appointment and depending on the property you will be advised what you will need.

  • What do I need to recover my firearm?
       You will need to provide proof of purchase and a valid DL, pass a background check and then an appointment will be set up to release the weapon.

  • My case has been disposed of, how do I recover my property?
       A motion to restore property from the presiding Judge needs to be presented
