Public Comment
Pursuant to Texas Government Code Section 551.042, public comment may not be used to discuss matters not posted on this agenda for consideration by the El Paso County Commissioners Court. Members of the public may only ask specific questions during public comment about a subject which has not been posted on the agenda which may be answered with specific, purely factual information. Discussions, deliberation, or debate on subjects which are not posted for consideration are not permitted during public comment.
Speaker's choice: Five (5) minutes per person during this segment regarding any items or three (3) minutes per person on each item as it appears on the agenda. The same will apply to any interest group consisting of three or more representatives. Commissioners Court retains the option to allow more comment as it deems necessary.
Notice to the Public
All matters listed under the Consent Agenda will be considered by the Commissioners Court to be routine and will be enacted by one motion in the form listed below. There will be no separate discussion of these items unless members of the Court or persons in the audience request that specific items be removed from the Consent Agenda to the Regular Agenda for discussion prior to the time the Commissioners Court votes on the motion to adopt the Consent Agenda.
All matters listed on the Consent Agenda and the Regular Agenda may be discussed in executive session at the option of the El Paso County Commissioners Court and following verbal announcement, if an appropriate exception to the open meeting requirement of the Texas Open Meetings Act is applicable.
Copies of the Agenda will be provided on audiotape upon request made a minimum of 48 hours prior to the meeting.

Approval of the Minutes of the regular meeting of April 16, 2012, and the special meetings of September 27, 2011; April 11, 2012 and April 17, 2012.

Approve and authorize the County Judge to sign the 65th Family Drug Court, Office of Juvenile Justice and Delinquency Prevention FY 2012 Family Drug Court Programs grant application funded by the US Department of Justice.  The grant amount is $549,127.00 for a period of thirty-six months.  There is $183,042.00 match from in-kind monies from staff salaries.  The grant application has been submitted for review and approval to the County Attorney's and County Auditor's Office.

Approve and authorize the termination of County contract KK-07-259, Financial Advisory Services Agreement, pursuant to Section IV therein, and authorize the County Judge to sign the letter of notice of termination.

Approve and authorize amendment No. 23 to the County of El Paso’s 2011-2012 operating budget.  This budgetary amendment will increase Grants by $10,000.00 as noted on the attachment, thus increasing the overall operating budget of $288,179,893.78 to $288,189,893.78.

Approve and authorize the County Judge to sign the Certificate of the County Judge of El Paso Texas regarding the related Public Hearing held in El Paso County for the City of Houston Higher Education Revenue Bonds (Cosmos Foundation, Inc.) Series 2012A, in accordance with the requirement of Section 147(f) of the Internal Revenue Code.

Rescind the Commissioners Court Orders from April 16, 2012 of Motion No. 21, Item # 37, to approve the agenda item to approve and authorize the County Judge to sign a legal services agreement with Brown McCarroll, LLP to represent the County in intervening in the El Paso Electric Company's rate case, and Motion # 22, Item # 38, to approve the agenda item to approve and authorize the County Judge to sign an Interlocal Agreement with other local governmental entities, including, but not limited to school districts, to collectively bear the cost to intervene in the El Paso Electric Company's rate case.

Approve the recommendation from the El Paso County Staffing Review Committee to approve Request #2012-016 to temporarily use funds from a vacant Auto Mechanic (GS-17) position to fund a full-time temporary Civil Communications Specialist-Certified (GS-20) position through the end of Fiscal Year 2012.

Approve and authorize the El Paso County Public Defender's Office to submit the Texas Indigent Defense Commission grant in the amount of $60,282 to fund an attorney position to represent clients of the County's Specialty Treatment Courts.  In addition, the department requests the County Judge to sign the attached Resolution as required by the grant.  The grant is for a minimum of twelve months and a maximum of four years.  There is a match requirement of $15,070.

Approve and authorize the El Paso County Public Defender's Office to submit the Texas Indigent Defense Commission grant in the amount of $32,000 to fund Tablet PC Upgrade.  In addition, the department requests the County Judge to sign the attached Resolution and Internet Submission form as required by the grant.  The grant is for a period of twelve months.  No match requirement.
